AZ Recruitment Limited (“the Company”) is a recruitment business which provides work finding services to its clients and work-seekers. The Company must process personal
data (including ‘sensitive’ personal data) so that it can provide these services. In so doing, the Company acts as a data controller.

You may give your personal details to the Company directly, such as on an application or registration form, CV, or via our website, or we may collect them from
another source, such as a jobs board. The Company must have a legal basis for processing your personal data. See below for more details. We will only use your personal data in accordance with the terms of this notice for the purposes of providing you with work-finding services and/or information relating to roles relevant to you.

What Is Personal Data?

The right to withdraw consent. This means that, if we are relying on your consent as the legal basis for using your personal data, you are free to withdraw that consent at any time.

This means that, if you have provided personal data to us directly, we are using it with your consent or for the performance of a contract, and that data is processed using automated means, you can ask us for a copy of that personal data to re-use with another service or business in many cases.

Rights relating to automated decision-making and profiling. We do not use your personal data in this way.

Recipient's of data

The Company will process your personal data and/or sensitive personal data with the
following recipients:

  • Clients (whom we may introduce or supply you to)
  • Former employers whom we may seek references from
  • Prospective employers when providing employment references
  • Payroll service providers who manage payroll on our behalf or other payment

Purpose of processing and legal basis

The Company will collect your personal data (which may include sensitive personal data) and will process your personal data for the purposes of providing you with work-finding services. This includes for example, contacting you about job opportunities, assessing your suitability for those opportunities, updating our databases, putting you forward for job opportunities, arranging payments to you and developing and managing our services and relationship with you and our clients. The Company also processes personal data for applicants for internal job vacancies. If you have opted-in we may also send you marketing information and news via email/ text. You can opt-out from receiving these at any time by clicking “unsubscribe” or contacting us directly when you receive these communications from us.

In some cases, we may be required to use your data for the purpose of investigating safeguarding allegations, reporting and detecting crime and also to comply with laws that apply to us. We may also use your information during the course of internal audits to demonstrate our compliance with certain industry standards.

We must have a legal basis to process your personal data. The legal bases we rely upon to offer our work-finding services to you are:

  • Legitimate interest will be relied on during the registration process up until the worker seeker is met for the final face to face interview.
  • Consent will be relied on from the point of the final face to face interview and to process any sensitive data for any work seekers
  • Legitimate interest will be relied on during the recruitment process for internal job applicants
  • Legal obligation will be relied on where processing is necessary to comply with
  • Employment law, Conduct of Employment Agencies and Employment Businesses Regulations 2003, HMRC and associated national minimum wage, social security and tax legislation and any other statutory guidance relevant to our industry

Legitimate interest

This is where the Company has a legitimate reason to process your data provided it is reasonable and does not go against what you would reasonably expect from us. Where the Company has relied on a legitimate interest to process your personal data.
Our legitimate interests are as follows:

  • Managing our database and keeping work-seeker records up to date
  • Providing work-finding services to you and our clients
  • Contacting you to seek your consent where we need it
  • Giving you information about similar products or services that you have used from us recently
  • Managing the recruitment process of internal job applicants

The Company will only use your personal data for the purposes for which it was originally collected, unless we reasonably believe that another purpose is compatible with those original purposes and need to use your personal data for that purpose. If we do use your personal data in this way and you wish us to explain how the new purpose is compatible with the original

If we need to use your personal data for a purpose that is unrelated to, or incompatible with, the purposes for which it was originally collected, we will inform
you and explain the legal basis which allows us to do so.
In some circumstances, where permitted or required by law, we may process your
personal data without your knowledge or consent. This will only be done within the
bounds of the Data Protection Legislation and your legal rights.


How Long Will You Keep My Personal Data?

The Company will only hold your personal data for as long as is necessary to fulfill the purposes for which we collected it. Different laws may also require us to keep data for different periods of time.

The Conduct of Employment Agencies and Employment Businesses Regulations 2003 require us to keep work-seeker records for at least one year from:

the date of their creation; or
after the date on which we last provide you with work-finding services.
Where the Company has obtained your consent to process your personal and sensitive data, we will do so in line with our Data Protection Policy. Upon expiry of the
period to which you have consented, the Company will seek further consent from you. Where consent is not granted, we will not continue to process your data.


How and Where Do You Store or Transfer My Personal Data?

Data is stored in a range of different places, including on your application record, company database, a secured storage system and in other IT systems (including the
Company’s email system).

Data security is very important to us, and to protect your data we have taken suitable measures to safeguard and secure data collected through our Site. Steps we take to
secure and protect your personal data include: Limiting access to our site, use of passwords and forced password changes and SSL encryption Only employees who need the information to perform a specific job (for example, consultants, administrators, our accounts and IT team or a marketing assistant) are granted access to your information.

The Company uses all reasonable efforts to safeguard your personal information. However, you should be aware that the use of email/ the Internet is not entirely secure and for this reason the Company cannot guarantee the security or integrity of any personal information which is transferred from you or to you via email/ the Internet. If you share a device with others we recommend that you do not select the
“remember my details” function when that option is offered. The security of your personal data is essential to us, and to protect your data, we take a number of important measures, including the following:

Limiting access to your personal data to those employees, contractors, and other third parties with a legitimate need to know and ensuring that they are subject to duties of confidentiality procedures for dealing with data breaches (the accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to, your
personal data) including notifying you and/or the Information Commissioner’s Office where we are legally required to do so;


How Can I Access My Personal Data?

If you want to know what personal data we hold about you, you can ask us for details of that personal data and for a copy of it. This is known as a “subject access request”. All subject access requests should be made in writing and sent to the email or postal addresses shown in Part 11.

There is not normally any charge for a subject access request. If your request is ‘manifestly unfounded or excessive’ (for example, if you make repetitive requests) a fee may be charged to cover our administrative costs in responding. We will respond to your subject access request within 30 days and, in any case, not more than one month of receiving it. Normally, we aim to provide a complete response, including a copy of your personal data within that time. In some cases, however, particularly if your request is more complex, more time may be required up to a maximum of three months from the date we receive your request. You will be kept fully informed of our progress.
